Purpose of the K-2 Visa

The K-2 visa is available to unmarried children of K-1 fiance visa applicants/holders who are below the age of 21 years old and are seeking to come to the United States for the purpose of adjusting status to a that of a U.S. permanent resident.

Eligibility Requirements for a K-2 Visa

To qualify for K-2 Visa, the child applicant must be:

  1. an unmarried child of a qualified K-1 fiance visa applicant;
  2. under the age of 21 years (adjustment to permanent resident status must also be completed before the child turns 21);
  3. seeking to come to the United States and adjust status to that of a permanent resident upon marriage of the child's K-1 parent to the parent's U.S. citizen fiance-petitioner within ninety days of entry of the K-1 parent into the U.S.

Supporting Documents for K-2 Visa

Supporting documents necessary to prove a child's eligibility for a K-2 visa will vary depending on the specifics of the case, but in general should include:

  1. evidence proving the child's relationship to the child's parent who is a qualified K-1 fiance visa holder/applicant;
  2. evidence proving the child is under the age of 21 years.
