Purpose of K-3 Spouse Visa

The purpose of the K-3 Spouse Visa is to allow spouses (and their children - see K-4 visa) of U.S. citizens who are waiting abroad for approval of the I-130 petition, to enter the United States to complete processing for permanent resident status (under the LIFE Act and Amendments of 2000).

Eligibility Requirements for K-3 Spouse Visa

In general, to qualify for a K-3 Spouse Visa you, the applicant, must:

  1. be legally married to a U.S. citizen;
  2. have legally terminated all previous marriages;
  3. be the beneficiary of a spouse petition filed on your behalf by your U.S. citizen spouse;
  4. intend to enter the U.S. to await approval of your spouse petition and subsequent adjustment to permanent residence status;

Supporting Documents for a K-3 Spouse Visa

Supporting documents necessary to prove your eligibility for a K-3 Spouse Visa will vary depending on the specifics of your case, but in general should include (but are not limited to):

  1. a copy of Form I-797, Notice of Action as evidence of your U.S. citizen spouse's filing of the I-130 spouse petition on your behalf;
  2. evidence of citizenship of U.S. citizen spouse including but not limited to copies of U.S. passport, copies of U.S. birth certificate, etc.;
  3. evidence of spousal relationship, including but not limited to copies of your marriage certificate, marriage photos, etc.;
  4. proof of legal termination of all previous marriages;
  5. evidence that the marriage was entered into in good faith, including but not limited to documentation showing joint ownership of property, common residence, common bank accounts, birth certificates of children, affidavits of third parties, joint tax returns, marriage photos, letters, etc.
