If you have not already paid the $89 consultation fee, please do so now by using Google Checkout's secure payment system.

To begin with, please review and approve the Consultation Agreement below.

Terms of Consultation:

1. Consulting Party agrees to provide full, complete, and truthful information, including any requested documents, to PowerVisa prior to commencement of the consultation.

2. Consulting Party agrees to pay the consultation fee of US$89 prior to commencement of the consultation.

3. Consulting Party understands and agrees that all telephone consultations shall be limited to 30 minutes and that it is the consulting party's responsibility to call in to PowerVisa (1-888-969-8472) at the designated consultation time (U.S. Mountain Time).

4. Consulting Party understands and agrees that all email consultations shall consist of a written response to questions raised on this form. PowerVisa shall respond only once to any follow-up questions by email. Further follow-up questions shall require an additional consultation fee.

5. Consulting Party understands and agrees that the consultation is limited to a single immigration topic. Consulting party may ask multiple questions pertaining to a single immigration topic. PowerVisa shall in its sole and reasonable discretion determine what qualifies as a single immigration topic. Questions arising from the same fact pattern shall, within reason, be treated as a single immigration topic.

6. Should the Consulting Party wish to retain PowerVisa as his/her legal representative in any immigration matter connected to this consultation, PowerVisa agrees to discount its attorney fees for the representation by the full amount of the consultation fees, SO LONG AS Consulting Party enters into a representation agreement with PowerVisa within 2 business days of the completion of this consultation.

7. Consulting Party understands and agrees that the consultation in itself does not create an attorney-client relationship and that PowerVisa is not obligated to and shall not act as Consulting Party's legal representative on any legal matter absent a written and signed representation agreement to that effect. While we will continue to maintain your confidential information, your legal relationship with PowerVisa ends upon the termination of your consultation phone call, or upon your receipt of PowerVisa’s written response to your question(s).

8. Consulting Party understands and agrees that the consultation shall be based upon information and materials provided by Consulting Party and PowerVisa shall bear no responsibility for requesting or obtaining additional documentation, or for verifying the truthfulness or accuracy of any statements or documentation provided.

9. Consulting Party understands and agrees that PowerVisa shall not be responsible for advising, reminding, or notifying Consulting Party of any sensitive dates or deadlines arising from facts disclosed or undisclosed to PowerVisa connected to this consultation, whether obvious or not. Absent a formal signed representation agreement, all dates and deadlines shall be the sole responsibility of Consulting Party.

10. DISCLAIMER OF WARRANTIES: TO THE MAXIMUM EXTENT PERMITTED BY LAW, THIS CONSULTATION SERVICE IS PROVIDED "AS-IS" AND, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POWERVISA AND ITS AFFILIATES, DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE.

11. GENERAL DISCLAIMER AND LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONSULTING PARTY AGREES NOT TO HOLD POWERVISA, ITS REPRESENTATIVES AND/OR AFFILIATES, LIABLE FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF CONSULTING PARTY'S USE OF THE CONSULTATION SERVICE. ADDITIONALLY, TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONSULTING PARTY'S EXCLUSIVE REMEDY AND THE ENTIRE LIABILITY OF POWERVISA AND ITS REPRESENTATIVES AND AFFILIATES, FOR ANY REASON, SHALL BE LIMITED TO THE AMOUNT PAID BY CONSULTING PARTY FOR THE CONSULTATION SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, POWERVISA, ITS REPRESENTATIVES AND AFFILIATES, SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES (INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF BUSINESS, CORRUPTION OR THEFT OF DATA, LOSS OF PROFITS OR INVESTMENT, OR THE LIKE), WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, PRODUCT LIABILITY OR OTHERWISE, EVEN IF POWERVISA OR ITS AFFILIATES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. IN NO EVENT DOES POWERVISA ASSUME ANY LIABILITY TO ANY PARTY OTHER THAN CONSULTING PARTY ARISING OUT OF YOUR CONSULTING PARTY'S USE OF THE CONSULTATION SERVICE.

12. Consulting Party understands and agrees that the limitations of damages and liability and the disclaimers of warranties set forth in this Agreement are fundamental elements of the basis of the business arrangement and bargain between PowerVisa and Consulting Party. Consulting Party acknowledges and agrees that PowerVisa would not be able to provide the Consultation Service at an economic price without such disclaimers and limitations of liability and that PowerVisa has set its prices for the Consultation Service in reliance upon such limitations of damages and liability and disclaimers of warranties. This Agreement is not intended to supersede the Terms of Use Agreement governing your use of the PowerVisa website, nor is the Terms of Use Agreement intended to supersede this Agreement. The two Agreements are intended to be construed together. The details of PowerVisa's online Terms of Use Agreement may be viewed by clicking on the appropriate links at the bottom of the PowerVisa website.

13. This Agreement is a complete statement of the agreement between Consulting Party and PowerVisa, and covers and sets forth the entire liability of PowerVisa, its employees, attorneys, and representatives and Consulting Party's sole and exclusive remedy regarding the Consultation Service. PowerVisa attorneys, representatives and employees are not authorized to make modifications or changes to this Agreement, or to make any additional representations, commitments, or warranties that may be binding on PowerVisa. Any waiver of the terms and conditions in this Agreement by PowerVisa must be in writing and signed by an authorized officer of PowerVisa and expressly reference the relevant and applicable provisions of this Agreement. If any provision of this Agreement is invalid or unenforceable under any applicable law, then it shall be, to that extent, deemed omitted and the remaining provisions and sections shall continue in full force and effect.

14. This Agreement shall be governed by Colorado law as applied to agreements entered into and to be performed entirely within Colorado, without regard to Colorado choice of law or conflicts of law principles, and applicable federal law. The parties hereby consent to the exclusive jurisdiction and venue in the state courts of Boulder County, Colorado and the Federal District Court, District of Colorado, U.S.A.
