PowerVisa Terms of Use Agreement

This “Terms of Use” is an Agreement between you, the user of this website (“User”), and PowerVisa, LLC (“PowerVisa”).  This Agreement covers the terms and conditions that apply to your use of PowerVisa websites and their respective web-pages.  Powervisa may change the Terms of Use Agreement from time to time.  By your use of PowerVisa’s websites, you agree to be legally bound by this Agreement and any future modifications to the terms and conditions herein.

No Attorney-Client Relationship:  ABSENT AN EXPRESS WRITTEN AGREEMENT BETWEEN POWERVISA AND A CLIENT, USE OF THIS WEBSITE DOES NOT AND IS NOT INTENDED TO CREATE AN ATTORNEY-CLIENT RELATIONSHIP BETWEEN USER AND POWERVISA OR ANY OF POWERVISA’S EMPLOYEES, INDEPENDENT CONTRACTOR’S, AGENTS, OR ATTORNEYS.  USER SHOULD NOT ACT OR RELY ON ANY INFORMATION IN THIS WEBSITE WITHOUT FIRST SEEKING THE ADVICE OF AN ATTORNEY.

User Communications and Privacy:  Powervisa has no obligation to monitor this website.  However, User agrees and acknowledges that Powervisa has the right to monitor the website electronically from time to time and to disclose any data or information as necessary or appropriate to satisfy any law, regulation or other governmental request, to operate the website properly, or to protect itself or its customers.  Powervisa will not intentionally monitor or disclose any private electronic-mail message unless required by law.  Unless otherwise indicated for a particular communication, any communications or material of any kind that User e-mails, posts or otherwise transmits through any PowerVisa website, including data, questions, comments, advice or suggestions ("User’s Communications") will be treated as non-confidential and non-proprietary.  Furthermore, Powervisa is free to use any ideas, concepts, know-how or techniques contained in User’s Communications for any purpose including, but not limited to, developing and marketing products using such data or information without compensation to User.

Non-compliance With Terms and Conditions and Termination:  User agrees and acknowledges that Powervisa may terminate User’s password or account or deny User access to all or part of the website without prior notice if User engages in any conduct or activities that Powervisa in its sole discretion believes violate any of the terms and conditions of this Agreement, violate the rights of Powervisa, or is otherwise inappropriate for continued access.

User agrees and acknowledges that Powervisa may in its sole discretion deny User access through the Powervisa site to any materials stored on the Internet, or to access third party services, merchandise or information on the Internet through Powervisa, and Powervisa shall have no responsibility to notify any third-party providers of services, merchandise or information nor any responsibility for any consequences resulting from lack of notification.

User agrees to defend, indemnify and hold Powervisa and its partner-affiliates harmless from any and all claims, liabilities, costs and expenses, including reasonable attorneys' fees, arising in any way from User’s use of the website or the placement or transmission of any message, information, software or other materials through the website by User or users of User’s account or related to any violation of this Agreement by User or users of User’s account.

Links from and to the PowerVisa Site:  User agree and acknowledge that Powervisa and any of its co-branding providers have no responsibility for the accuracy or availability of information provided by linked sites.  Links to external sites do not constitute an endorsement by Powervisa or its site co-branding providers of the sponsors of such sites or the content, products, advertising or other materials presented on such sites.

Information in the many web pages that are linked to the PowerVisa site comes from a variety of sources.  Some of this information comes from official Powervisa licensees, but much of it comes from unofficial or unaffiliated organizations and individuals, both internal and external to Powervisa.  Powervisa does not author, edit, or monitor these unofficial pages or links.  User agree and acknowledge that Powervisa and its Co-branding Providers shall not be responsible or liable, directly or indirectly, for any losses or damages caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on such external sites or resources.

Security:  Powervisa is taking reasonable and appropriate security measures, including encryption, to ensure that User’s personal data and information is disclosed only to those specified and consented to by User.  However, the Internet is an open system and we cannot and do not guarantee that the personal data and information User have entered will not be intercepted by others and decrypted.

If User wishes to make purchases through any PowerVisa website, User may be asked by the merchant or information or service provider from whom User is making the purchase to supply certain data and information, including credit card or other payment method information.  User agrees not to hold Powervisa liable for any damages or losses of any sort incurred as a result of any such dealings with any merchant or information or service provider through operating through any of PowerVisa’s website.  User agrees that all data and information User provides any merchant or information or service provider through the website for purposes of making purchases will be accurate, complete and current.  The merchants and information and service providers offering merchandise, information and services through the website set their own prices and may change prices or institute new prices at any time.  User agrees to pay all charges incurred by users of User’s account and credit card or other payment mechanism at the prices in effect when such charges are incurred.  User also will be responsible for paying any applicable fees relating to purchases through any of PowerVisa’s websites.

Attorney Ethics:  This website may be considered advertising in some jurisdictions under applicable law and ethics rules.  The hiring of an immigration lawyer is an extremely important decision that should not be based solely upon advertisements, website content, or any other written representations.  Before User makes such a decision, PowerVisa would be pleased to send User, at no charge, documentation about the qualifications and experience of our immigration attorneys.

PowerVisa does not offer any guarantee success in obtaining a visa or other immigration benefits.  Past success does not guarantee success in any present or future legal representation.

Miscellaneous:  This Terms of Use Agreement and the relationship between User and Powervisa shall be governed by the laws of the State of Colorado without regard to its conflict of law provisions.  User and Powervisa agree to submit to the personal and exclusive jurisdiction of the courts located within the State of Colorado.

The failure of Powervisa to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision.  If any provision of the Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms of Use remain in full force and effect.
